Terms & Conditions
These terms explain how DovixSoft works with clients and website visitors. Please read them together with any proposal or written agreement for your project.
1. Introduction and scope
These Terms & Conditions apply to your use of the DovixSoft website (dovixsoft.com) and to the enquiries, proposals and services we provide to businesses and individuals. In these terms, "DovixSoft", "we" and "us" mean the business operating under the DovixSoft name, and "you" and "client" mean the person or organization contacting or engaging us.
DovixSoft is operated as a sole proprietorship. You can contact us using the details in section 12.
- If we agree a project in a separate written proposal, statement of work or agreement, that document governs the project. If it conflicts with these terms, the project document applies to the extent of the conflict.
- These terms do not limit any rights you have under applicable law that cannot lawfully be excluded.
- We may update these terms from time to time. The date above shows the latest version. Updates do not change the terms of a project already agreed in writing unless both sides agree.
- By using this website or engaging DovixSoft, you accept these terms. If you do not accept them, please do not use our services.
2. Service agreements and project scope
Our services include business websites, full-stack web applications, custom software, API and third-party integrations, AI integration, workflow automation, e-commerce setups, startup MVP planning, website repair and redesign, and technical SEO. The descriptions on this website are general information, not a promise of any specific outcome or an offer to enter a contract.
- A project starts only when the scope, price, timeline and commercial terms have been agreed in writing, for example in a proposal, estimate or written confirmation by email or message.
- Where a project calls for it, we may work with independent developers or partners.
- We integrate third-party AI services into applications and workflows. We do not claim to provide proprietary AI models.
3. Acceptable and prohibited uses
Responsible development policy. DovixSoft does not develop, support, or facilitate unlawful activities, fraudulent schemes, malicious software intended for harm, or unauthorized access. Projects must comply with applicable laws and our responsible development standards.
In practice, we will not work on, or continue working on, a project that is intended to be used for any of the following:
- fraud, scams, phishing or other deceptive schemes, including impersonating a person or organization;
- malware, ransomware, spyware or other software intended to cause harm;
- unauthorized access to computer systems, accounts, networks or data, or bypassing security controls without the owner's permission;
- collecting, using or selling personal data in breach of applicable privacy and data protection laws;
- infringing the intellectual property rights of others, or publishing unlawful content;
- facilitating financial crime, such as money laundering; or
- any other activity that violates applicable laws.
Legitimate, authorized security work is not prohibited. For example, testing or hardening a system with the written permission of its owner may be acceptable, subject to our review and a clearly agreed written scope. We may also ask about a project's purpose and intended users before we agree to work on it.
4. Client responsibilities and permissions
To deliver a project well, we rely on you to:
- provide accurate and complete information, and give feedback and approvals in reasonable time;
- confirm that you have the right to give us any content, text, images, logos, data, code, accounts or access credentials you provide, and that using them for the project does not infringe third-party rights or breach any law or contract;
- obtain the permissions and consents your project needs, including licenses for third-party materials and authorization to access any system or account we are asked to work on;
- keep access credentials secure and share only the access that is needed for the work;
- meet the legal requirements that apply to your own business and website, unless we have agreed in writing to handle a specific compliance task; and
- pay the costs of third-party services such as hosting, domains, cloud services, payment gateways and AI service providers, which are separate from our development fees and are governed by those providers' own terms.
We will not publicly list your project in our portfolio without your permission.
5. Changes, delivery estimates and approvals
- Scope. The scope of a project is what is described in the agreed proposal or agreement.
- Changes. A request that goes beyond the agreed scope is a change request. It may affect price and timeline, and we will discuss it with you before starting that work.
- Approvals. We may ask you to approve designs, content or completed stages. Approvals and requested changes should be confirmed in writing, and work continues on the basis of what you have approved.
- Timelines. Delivery timelines are estimates unless we expressly agree a fixed date in writing. They depend on timely input, content and approvals from you and on the availability of third-party services. We do not promise fixed delivery times before we understand the scope.
- Delivery. Work is tested, reviewed with you and delivered against the agreed scope and acceptance criteria. Please tell us about any issues within the review period stated in your agreement.
- Support. Maintenance and support after delivery are agreed separately for each project.
- Results. We do not guarantee search rankings, traffic, sales or other business results.
6. Payments and cancellations
- Pricing. Prices are not published on this website. They are discussed with you personally, based on your project requirements, and set out in a proposal or estimate. Any applicable taxes will be stated separately.
- What fees cover. Our fees cover development work. Hosting, cloud and third-party service costs are separate.
- Payments. Payment milestones, any advance payment and due dates are agreed per project. If an agreed payment is overdue, we may pause work after notifying you.
- Cancellations. Either side may cancel a project as set out in the project agreement. Unless agreed otherwise, and to the extent permitted by law, fees for work completed and costs already incurred up to the cancellation date remain payable.
- Refunds. Any refund terms are set out in the project agreement. Nothing in this section affects rights you have under applicable law.
7. Intellectual property and licensing
- Your materials. You keep ownership of the content, data, brand assets and other materials you provide. You allow us to use them only as needed to deliver your project.
- Deliverables. Ownership and license terms for the work we create for you are set out in the project agreement. Unless agreed otherwise, once all agreed fees are paid in full, you may use the custom deliverables created specifically for you for your business purposes.
- Third-party components. Open-source libraries, frameworks, fonts, stock assets, APIs and similar components stay subject to their own licenses.
- Our tools and know-how. We keep our pre-existing tools, code libraries, methods and know-how that are not specific to your project.
- Our brand and website. The DovixSoft name, logo and website content belong to us. Please do not copy or reuse them without our permission.
8. Confidentiality
- Each side will keep the other's non-public business information, credentials, source code and data confidential and use it only for the project.
- This does not apply to information that is public, was already known to the receiving side, was developed independently, or must be disclosed by law or by a lawful request from an authority.
- We will take reasonable steps to make sure that any independent developers or partners we involve in your project are bound to keep your confidential information confidential.
- These obligations continue after the project ends. If you need a separate written non-disclosure agreement, please tell us before you share sensitive information.
9. Privacy and personal information
When you contact us, for example by WhatsApp or email, we receive the information you choose to send, such as your name, contact details and project requirements. We use it to respond to you, prepare proposals and deliver services you request, and we handle it in line with applicable law.
- WhatsApp, email and social media platforms are run by third parties and are governed by their own terms and privacy policies.
- If a project involves personal data of your customers or users, you remain responsible for having a lawful basis to share that data with us and for your own compliance. Any specific data-handling requirements for the project should be agreed in the project agreement.
- Our Privacy Policy explains in more detail what information we receive and how we handle it, and applies alongside these terms.
10. Project rejection and termination
We may decline a project, or pause or end work on one, if:
- the project or its intended use breaks the law or the standards in section 3;
- information or materials provided to us turn out to be false, misleading or unlawful;
- agreed payments remain unpaid after we have given you notice; or
- abusive or threatening behavior makes it unreasonable to continue.
Where we end a project because of a prohibited use, we are not required to complete or deliver the work, and we may cooperate with lawful requests from authorities. You may also end a project by giving written notice, and section 6 explains what remains payable. When a project ends, we will return or delete your confidential materials on request, subject to what the law requires us to keep.
11. Limitations of liability
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, such as liability for fraud. Subject to that, and only to the extent permitted by applicable law:
- we are not liable for indirect or consequential losses, such as lost profits, lost business or lost data, arising from our website or services;
- our total liability for a project is limited to the fees you paid us for that project, unless the project agreement says otherwise;
- we are not responsible for failures or changes of third-party services outside our reasonable control, such as hosting, domain, payment, messaging or AI service providers; and
- AI-generated output can be inaccurate, so you should review AI-assisted features before relying on them.
Governing law and disputes. These terms are governed by the laws of India. Any dispute that cannot be settled by discussion is subject to the competent courts in India.
